Kigai Holt's Terms of Service

Thank you for considering a commission from me!
Please read below to learn about the processes and regulations behind my work

Agreeing to a commission from me is agreeing to the following terms of service. Please read thoroughly before agreeing to a commission from me.

Things I will NOT do

1. Erotic or sexually themed scenes
-If the piece is centered around sex, I will not do it, it's simply not something I want in my gallery. I will do tasteful nudity however, please discuss the details of a piece with me to clarify.
-PLEASE feel free to ask about ANY content, I won't bite your head off, and would be happy to discuss it with you.

2. Anti-literature/art/group pieces
-Though there are some things I disagree with in the media and the world in general, I don't want that mood to get into my gallery. Please leave anti-anything at the door.

3. Chibi, anime, or fan-art (That includes ponies).
-These styles simply do not agree with me.

Things I will do

1. Animals, anthros, were's.
-My gallery may be booming with wolf content, but I am very capable of doing other creatures as well! Please do not hesitate to ask about any species you have in mind :)

2. Humans
-I prefer to have a photo reference, or a detailed description (including personality traits), and please note that humans are a difficult subject for me, and it may take longer for me to finish a commission featuring one.

3. Other fantasy creatures

4. Violence and gore

Payment Methods

I charge full price up front on all commissions, unless you choose to go the concept to purchase method (see below). The payment is only partially refundable depending on the progress of the commission upon killing.

For example, if you were to cancel a commission that is 20% finished, you would receive an 80% refund. If you were to cancel a commission that is 75% finished, you would receive a 25% refund. The % of progress in the commission is entirely up to my discretion.

Concept to Purchase Method

If you wish to get an idea for how the commission will turn out prior to paying the full price however, I am willing to draw a concept sketch for a deposit of 10% of the full price of your commission. This is a non-refundable fee.

Timeframe

I am a biologist in real life, and in search of work, my artistic life is not my primary form of income, thusly it is not my top priority in my life. That being said, I do prefer to maintain a relatively short wait-time on commissions.

It takes 1-4 weeks for commissions to be completed, depending on the complexity of the commission. Meaning that if you're 4th in line on the to-do list, it may take upwards of 12 weeks for me to get to and complete your commission. Quality of the piece is far more important to me than the speed.

If you have a deadline you MUST receive the commission by (for example, a con you're attending), discuss this with me upon purchase, and we can arrange something, it will most likely require a rush fee however.

I try to work in the order I receive commissions, but every now and then I get inspiration for a piece further down the line, and I get it on paper. Again, I prefer to work in order, but please realize that it doesn't always work out like that.

Revisions

The earlier the better. More can be changed the earlier you ask for the changes. After the coloring phase has begun, changes are near impossible to make, unless it's something very small.

The larger the commission, the more work-in-progress images I'll upload, allowing for more changes.

Shipping

Due to the fact that my artwork is traditional, you may request the original piece of work to be sent to you. This does require an extra shipping fee, as shipping the work safely (to prevent smudging and bending damage) can cost a decent amount. I've categorized the prices to make the process easier.

-Shipping within U.S.A,: $6.00

-Shipping outside of the U.S.A: Varies

The actual costs of shipping the artwork often come out more expensive than the fees I charge above, I do apologize for the prices, but they are necessary to maintain any form of profit from the commissions.

Should you commission a piece larger than 9"x12" shipping will likely cost more than the above fees, we can discuss the actual price on a case by case basis.

Should a piece of work be left in my possession for more than 6 months, I reserve the right to sell the original. Feel free to contact me beyond the 6 months to determine whether or not the piece is still in my possession. If so, I would still be willing to send it to you for the same shipping price.

Courtesy, and Patience is expected

Almost every commissioner I've had has been excellent to work with, but to cover my bases, I would like to mention that courtesy, and especially patience is expected. Pestering, or being overly demanding or disrespectful will destroy any inspiration behind your drawing, and if the commission were to somehow continue, it would not come out well.

In short, please be courteous, and patient when working with me. If I take longer than the timeframes mentioned above, feel free to remind me, or check up on your status, things may have been pushed back for some reason. But please refrain from contacting me on a regular basis about a commission if at all possible, when I've progressed on a commission, I will contact you!

Should this policy be broken, I will have to cancel (kill) the commission. The rate of refund will be the same as above, with a maximum of 75%, even if the commission has not been started. I retain the right to keep a minimum 25% should there be disrespectful or overly demanding behavior to the point of affecting a commission.

Rights

I retain all rights to the artwork, this includes any and all electronic rights and usage. I retain the right to sell, reproduce, show, display, and in general, use the artwork as I see fit. Should a day come when I begin selling prints on a more regular basis, I retain the right to sell prints of your commission to the public.

Should you wish to purchase the rights so that I may not use your work as stated above, please discuss this with me. Feel free to post the image anywhere you'd like, edit the image as you wish, and use it as you wish. You may not however, reproduce the piece for sale. Such usage for a business or for sale must be discussed with me, as legally binding contracts must be made and signed for such usage.

Final Note
Again, I've had very few instances where I've had to remind commissioners about my TOS, but they are here for a reason. Thank you very much for reading through this, and soon I hope to hear about what I can draw for you!
